Rental Property Hearing Board

Authorization:   Adoption of Ordinance 14-07 as amended by Substitute Ordinance 14B-07 added Chapter 1463, “Rental Housing.”                                               

Appointing Authority:  Mayor and City Commission. 

Purpose:          To regulate the lease or rental of any dwelling, the inspection of rental dwellings, and the issuance and suspension of rental permits, was adopted on October 16, 2007.  The Ordinance calls for the establishment of a Rental Property Hearing Board to hear appeals from individuals contesting action by the City in the enforcement of this ordinance. 

Persons entitled to a hearing include (1) a rental permit applicant who has been granted a conditional permit; (2) a rental permit applicant who has been denied a permit; (3) a rental permittee who has been given notice of rental permit sanction action; (4) an owner or owner’s legal agent who has been given an Order to Vacate a premises; and (5) a tenant who has received an Order to Vacate a premises or whose landlord has received notice of rental sanction action or been given an Order to Vacate. 

Members:         The Hearing Board shall consist of the Assistant City Manager, two City electors, and one City elector as an alternate, appointed by the Mayor and approved by the City Commission for two-year terms. 

Term:               Two years.  Current terms expire January 8, 2010.
