Appeals Process

Anyone who receives notice from the City of Battle Creek Code Compliance Departments that his or her house or building project has a violation of the City’s Housing Code has the right to appeal that decision. This appeal is heard by an independent board made up of residents. Below is a description of the official purpose of the Housing Board of Appeals and its makeup.

A Housing Board of Appeals is established for the purpose of hearing and deciding appeals concerning the application or interpretation of the provisions and standards of the City of Battle Creek's Housing Code.  Prior to the hearing of an appeal, the City shall forward to the Housing Board of Appeals the appeal form, a copy of the notice or order being appealed and a summary report of all previous action taken.  After all evidence and testimony has been presented, the Housing Board of Appeals shall affirm modify or reverse the order or notice being appealed.

The Housing Board of Appeals is appointed by the City Commission and consists of the following members

  1. A building contractor

  2. A registered architect or engineer

  3. Two members of the general public; and

  4. An individual registered as a building official, plan reviewer or inspector under the Building Officials and Inspector Registration Act, being Act 54 of the Public Acts of 1986 as amended.  This individual may be an employee of the City.
